On February 11, 2021, the Directorate General of Trade Remedies of India (DGTR) announced the initiation of a mid-term review to review the product scope of definitive countervailing imposed on “Welded Stainless Pipes and Tubes” originating in or exported from China and Vietnam.

The midterm of the countervailing review was requested by Kunshan Kinglai Hygienic Material to exclude products that meet the Bioprocessing Equipment (ASME-BPE) standard of the American Society of Mechanical Engineers (ASME), from the scope product under consideration in the original investigation according to Notice No. 4/2019-Customs (CVD) of September 17, 2019.

Product under consideration is welded stainless steel pipes and tubes and is classified according to HS codes 7306.40, 7306.61, 7306.69, 7306.11, 7306.21.

This survey is only intended to reassess the product range and consider the exclusion of certain products with special standards that cannot be produced by the Indian industry. DGTR will not reconsider the margin of subsidy and damage in the original countervailing case.

Related parties can contact and submit necessary information and documents to DGTR via email address: adg12-dgtr@gov.in, adv13-dgtr@gov.in, jd12-dgtr@gov.in and dd16-dgtr@gov.in within 30 days from the date of the receipt of the notice. If no information is received within the prescribed time-limit or the information received is incomplete, the Authority may record its findings on the basis if the facts are available on records.

Besides, related parties should study and strictly follow DGTR’s instructions in the information submission procedure to be fully and comprehensively reviewed by the information and the data provided.

In the case of exports of products that have obtained special certifications and to ensure the legitimate interests of the business, the exporting/producing enterprises shall:

– Read carefully the instructions, coordinate with Indian importers to provide information to prove and recommend the exclusion of these products from the scope of tax imposition.

– Comprehensive cooperation with DGTR to exchange information and receive timely support.
