On May 23, 2016, the Malaysian Ministry of Industry and International Trade (MITI) issued the final decision on the anti-dumping investigation with Cold rolled steel originating or exported from Vietnam and China, and Korea. The requesting party was CSC Steel Sdn. Bhd – represents the domestic Cold rolled steel industry.
The products under investigation are Cold rolled alloy and non-alloy steel coils with a thickness of 0.2 mm – 2.6 mm and width of 700 mm – 1300 mm, under HS codes: 7209.15, 7209.16, 7209.17, 7209.18, 7209.18, and 7225.50.
Accordingly, the final tax rate is from 3.06% to 13.68%, of which POSCO Vietnam is subject to 3.06% and other exporters at 13.68%. An anti-dumping duty order will be in effect for 5 years from 24 May 2016 to 23 May 2021.
On 23/11/2020, in order to prepare the necessary data for the upcoming sunset review, MITI sent a notice to interested parties that could be affected if this anti-dumping duty was terminated. MITI will use the views and evidence provided by interested parties to evaluate:
- Whether the continued imposition of the anti-dumping duties is necessary to offset the dumping of the subject merchandise; and
- Whether the injury would likely to continue or recur if the duties were removed.
Thus, if MITI does not receive any request from interested parties, it means that domestic producers will no longer be affected by the flow of imported goods from abroad, the domestic market of Malaysia has become more stable and the competitiveness between domestic and imported goods has gradually regained the balance. From here, the manufacturers will not hesitate to “re-export” in this market.
However, if MITI moves to extend the deadline for imposing anti-dumping duties, exporters should be more cautious, and carefully consider whether they have really stopped the dumping act. If the anti-dumping duty is still applied, it will cause a great obstacle for exporters because it seems that the export of goods in recent years has been very limited, many exporters lose a potential market only because of a barrier called tariffs.
