After a thorough investigation, the US Department of Commerce has concluded that steel pipe products imported from Vietnam did not evade the anti-dumping and countervailing duties that the US applies to similar goods from Taiwan.It's known that on August 4, 2022, the US Department of Commerce issued a notice to initiate an investigation into the circumvention of trade defense duties on certain steel pipe products. Primarily, products falling under HS codes 7306.61 and 7306.30 were imported from Vietnam, with allegations that Vietnam imported the main raw material for producing the steel pipe hot-rolled coil from China, Taiwan, South Korea, and India, then performed simple processing to manufacture the steel pipes, which were subsequently exported to the US. This process was purportedly aimed at evading the corresponding anti-dumping and countervailing duties that the US applies to these countries and territories.This investigation was conducted following suspicions that goods from Vietnam were being sold at lower prices to evade anti-dumping and subsidy tariffs. The investigation focused on determining whether these steel pipe products were manufactured at lower costs due to non-transparent subsidies.After conducting an investigation and gathering information from relevant parties, the United States recently reached a significant conclusion regarding the anti-avoidance duty investigation related to the import of steel pipes from Vietnam. According to the announcement from the US Department of Commerce, following a thorough investigation, it was concluded that steel products imported from Vietnam did not evade the anti-dumping and countervailing duties that the US applies to similar items from Taiwan. This determination was based on Vietnam not using hot-rolled coil steel from Taiwan to manufacture the steel pipes.For other steel pipe products also under investigation for anti-avoidance measures (initiated on July 29, 2022), on July 20, 2023, the US Department of Commerce announced an extension of the deadline for issuing the final determination until November 2, 2023. Recently, on November 9, the US Department of Commerce published the final determination on the case. In this final determination, the US Department of Commerce maintained the same conclusion as the preliminary finding issued in April 2023.However, the Ministry of Industry and Trade noted that the US Department of Commerce continues to allow Vietnamese exporters (except for companies determined by the US Department of Commerce to not fully cooperate during the investigation) to participate in the mechanism of self-certification, confirming that they do not use hot-rolled coil steel originating from China, Taiwan, South Korea or India to be exempt from measures.In fact, the US investigation into anti-avoidance duties isn't just a message about fair trade management, it's also evidence of the tension within international trade relations, particularly amidst escalating trade tensions between nations. Accordingly, Vietnam's stainless steel wire does not evade anti-dumping duty in the US.1. The US: Vietnamese stainless steel wire products not circumventing US anti-dumping dutyAccording to the report of the United States International Trade Commission (USITC), the output of stainless steel wire (HS 7223) of Vietnam exported to the US market in 2021 will reach about 4.9 million USD. In May 2021, North American Stainless (NAS) company requested the US Department of Commerce (DOC) to investigate the evasion of anti-dumping duty on stainless steel round wire products imported from Vietnam because of its suspicion of products HS 7223 is manufactured from imported materials from Korea. Accordingly, the United States imposed a definitive anti-dumping duty on stainless steel wire from Korea at the rate of 4.73%, applicable from February 24, 2022.In February 2022, at the request of the US manufacturer, the DOC officially initiated an investigation from January 1, 2020 to December 31, 2021.In December 2022, the DOC made a preliminary conclusion of the case, according to which Vietnam's stainless steel wire products manufactured from materials imported from Korea didn’t violate the anti-dumping duty that the United States is applying with similar products from Korea.Recently, the Trade Remedies Administration said that on May 22, 2023, the US Department of Commerce maintained the statement in its previous preliminary conclusion in December 2022.Thanks to the efforts and support of the Ministry of Industry and Trade, relevant ministries and branches of Vietnam have achieved positive results in the case of HS 7223 steel product investigation. This has led to an alarming capacity utilization rate of under 30% in Thailand's steel industry. The steel consumption data for the first five months of 2023 shows 7.17 million tons, with a domestic production of 2.81 million tons and imports of 4.99 million tons, increasing by 15.6%. Malaysia has imposed definitive anti-dumping duties on Japanese cold-rolled steel coils after the Ministry of Investment, Trade and Industry (MITI) concluded its investigation earlier this year. At the same time, Malaysia also announced the end of trade defense measures on cold rolled steel imported from Vietnam.1. Malaysia: Anti-dumping investigation on Japanese cold rolled steelAccording to MITI's report, Malaysia's steel plate demand in 2022 reached 3.5 million tons, down 5.4% compared to the previous year. In the same year, import and export of steel plates both decreased by about 6-7% compared to 2021. Meanwhile, Malaysian cold-rolled steel prices remained highly competitive due to the massive import of cheap steel from abroad.This posed a significant threat to the development and business operations of domestic factories. Malaysia: Applying anti-dumping duty on Japanese cold rolling millsOn September 29, 2023, Malaysia imposed anti-dumping duties on Japanese cold-rolled coils of iron or non-alloy steel with thickness of 0.2-2.6mm and width of 700-1300m after completing the investigation. Accordingly, the Malaysian government has imposed a duty rate of 9.03% on Nippon Steel Corporation and 22.62% on other manufacturers, effective until September 28, 2028. However, due to the benefits of black plate and cold-rolled steel coils for the automobile, electronics industries are so great, Malaysia has excluded AD for these products.3. Malaysia: Ending anti-dumping measures on Vietnam's cold-rolled steelAccording to the Trade Defense Department, on March 21, 2019, MITI initiated an investigation of cold-rolled coils of iron or non-alloy steel with a width above 1300mm imported from Japan, Korea, China and Vietnam.By December 17, 2019, the government had applied definitive anti-dumping duty rates as follows: China 4.76% - 26.38% of the CIF value, Japan 26.39% of the CIF value, Korea 7.7% or 20.13% of the CIF value. This rate is effective for 5 years, from December 25, 2019 to December 24, 2024.In addition, other products from Vietnam and Korea are also under investigation including alloy/non-alloy cold rolled steel coils with thicknesses 0.2 - 2.6mm and widths 700 - 1300mm. The case has undergone many sunset reviews and received a decision to continue imposing anti-dumping duty, effective until October 8, 2026 at a rate of 0 - 21.64% for Korea and 7.42 - 33.7% for Vietnam. However, under the petition efforts of the Vietnamese government, MITI founded that Vietnam did not violate export conditions, the dumping margin was less than 2% of the export price. Therefore, Malaysia ended anti-dumping measures on the above products. On August 14, the European Commission suddenly announced an anti-dumping investigation on cold-rolled stainless steel products originating from Vietnam to resolve suspicions of trade remedy measures circumvention from Indonesia's anti-dumping.Vietnam cold-rolled stainless steel was suddenly investigated for anti-dumpingOn July 3, the European Commission received a request from the European Steel Association (EUROFER) to investigate the possibility of circumventing anti-dumping and anti-subsidy measures on cold-rolled stainless steel from Vietnam, Taiwan, and Turkey. Accordingly, the European Commission suspects that cold-rolled stainless steel products in Vietnam actually originate from Indonesia when this country is currently imposing anti-dumping measures.On August 14, the European Commission launched a circumvention investigation related to anti-dumping, according to which the process is expected to last for 9 months. Specifically, the involved products are on the list of flat-rolled stainless steel products, and they are classified under HS Code including 7219 31 00, 7219 32 10, 7219 32 90, 7219 33 10, 7219 33 90, 7219 34 10, 7219 34 90, 7219 35 10, 7219 35 90, 721 9 90 20, 7219 90 80, 7220 20 21, 7220 20 29, 7220 20 41, 7220 20 49, 7220 20 81, 7220 20 89, 7220 90 20 and 7220 90 80.Because the evasion occurs outside the Union, manufacturers from Vietnam, Taiwan, and Turkey can request exemption opinions from investigation measures. Relevant parties or legal representatives must be present and submit responses within 15 days from the effective date to consult on initiating an investigation.The reason for the anti-dumping investigationEUROFER suspects that stainless steel producers in Indonesia have received significant support from the government in exporting hot-rolled stainless steel to several countries including Vietnam. These products re-export finished stainless steel products and cold rolled stainless steel to the European market.There has been some evidence that stainless steel billets/sheets originating from Indonesia were assembled and finished in Vietnam, Taiwan, and Turkey before they were imported into the European market. Meanwhile, stainless steel sheet products originating from Indonesia have been subject to anti-dumping measures since November 2021.Eurofer General Director Axel Eggert said: "Since the application of anti-subsidy and anti-dumping measures, direct import of cold-rolled stainless steel products from Indonesia has decreased significantly." According to data from MEPS International analysis, Indonesia's stainless steel import volume to the European market peaked at 38,205 tons in the fourth quarter of 2021. By the second quarter of 2022, the import volume had decreased by 74% to 9,781 tons.Currently, Vietnam is the only country among the three countries that recorded a growth in cold-rolled stainless steel exports directly to Europe with output increasing from 11,298 tons to 18,883 tons from the first quarter 4 of 2021 until the second quarter of this year. Accordingly, the mentioned time coincided with when Indonesia began reducing steel imports into the EU market.Opportunities for Vietnamese stainless steel manufacturersThe rapid increase in Vietnam's steel export turnover in recent years has attracted the attention of many countries, leading to a high rate of trade remedy investigations.
